GOP Resolution Being Presented To Board of Supervisors

Adopted by THE  GREENE COUNTY REPUBLICAN COMMITTEE
Resolution Calling Greene County to Adopt a 2nd Amendment Preservation Ordinance
Whereas, the Second Amendment of the United States Constitution explicitly states: “the right of the
people to keep and bear Arms, shall not be infringed”; and
Whereas, the Supreme Court of the United States of America has affirmed that the Second Amendment
protects the right of an individual to bear arms, and that affirmation applies on both federal land (Heller vs.
Washington, D.C.), and within the several states (MacDonald vs. The City of Chicago); and
Whereas, Article 1, Section 13 of the Constitution of Virginia also states explicitly: “…the right of the
people to keep and bear arms shall not be infringed;” and that…”in all cases the military should be under
strict subordination to, and governed by, the civil power”; and
Whereas, certain legislation introduced in both the 2019 session of the Virginia General Assembly and
the special session called by Governor Northam, and certain legislation introduced in the current session
of the United States Congress could have the effect of infringing on the rights of law abiding citizens to
keep and bear arms, as guaranteed by both the United States and Virginia Constitutions; and
Whereas, all federal acts, laws, orders, rules or regulations regarding firearms, firearms accessories, and
ammunition are a violation of the Second Amendment; and
Whereas, a focus on controlling guns rather than the ultimate goal of preventing violence is presumptuous,
an approach that is unsupported by sound social science, and is belied by actual experience; and
Whereas, the right to be free from the commandeering hand of the federal government has been most
notably recognized by the United States Supreme Court in Printz v. United States when the Court held:
‘The Federal Government may neither issue directives requiring the States to address particular
problems, nor command the States’ officers, or those of their political subdivisions, to administer or
enforce a federal regulatory program’; therefore
BE IT HEREBY RESOLVED that the Greene County Republican Committee calls on the Greene County
Board of Supervisors to adopt an ordinance to be known and cited as the “Second Amendment
Preservation Ordinance”; and
BE IT FURTHER RESOLVED that this Committee hereby requests that this Ordinance will expressly
prohibit material support or resources for the enforcement of Federal or State Acts regarding firearms,
firearm accessories and ammunition; provides a severability clause; provides for publication; and
establishes an effective date; and
BE IT FURTHER RESOLVED that this Committee will supply a model copy for this legislation; and
BE IT FURTHER RESOLVED that this Committee respectfully requests that the Greene County Board of
Supervisors enact and publish this Ordinance prior to the convening of the General Assembly in January.
